In 1864, John was at the Battle of Peach Tree Georgia, north of Atlanta, when he collapsed on the field. He suffered from flu like symptons and had difficulty breathing. After the war he applied for a pension stating that could only do the work of 'half a hand'. He was granted a pension based on military service and received it until his death. At that time, his widow, Loucinda Davis Spencer made application for the pension and received it until her death.

While there he was (murdered) killed or disposed of by the Guards for complaining constantly about his treatment by the confederates.
